Terms and Conditions - Landscapers Lee
Welcome to our Terms and Conditions page for Landscapers Lee. This article explains the key rules, responsibilities, and expectations that apply when you use our landscaping-related services, request work, or engage with our team. Please read the following information carefully, as it describes how services are provided, what is expected from both parties, and the important limitations and obligations that help ensure a smooth and professional working relationship.
By choosing to proceed with any service, quotation, estimate, consultation, or project arrangement, you acknowledge that you have read, understood, and agreed to these terms. These terms are designed to protect both the customer and the business by creating clear standards for service delivery, payments, scheduling, cancellations, and project scope.
1. Acceptance of Terms
When a customer requests services from Landscapers Lee, whether for garden maintenance, landscaping improvements, site preparation, planting, turf installation, or similar work, the request is considered an agreement to follow these terms and conditions. It is the customer’s responsibility to review all details provided before confirming any job. If any part of these terms is unclear, the customer should seek clarification before work begins.
Using our services means you agree that all work will be carried out according to the agreed scope, pricing structure, and project timeline where applicable.
2. Service Scope
All landscaping work is performed based on the agreed scope of the project. The scope may include a wide range of tasks such as lawn care, hedge trimming, garden clearance, planting, soil preparation, fencing-related assistance, and other outdoor maintenance services. The exact services to be provided must be confirmed before work starts.
Any task not included in the original agreement may require a revised quote or additional approval. This is especially important where unforeseen conditions are discovered during work, such as hidden roots, poor drainage, unstable ground, excessive waste, or access difficulties. In such cases, the scope may need to be adjusted to reflect the actual conditions on site.
2.1 Changes to Scope
If the customer requests a change to the original plan, the revised work may affect timing, resources, and costs. Landscapers Lee reserves the right to review and amend the quote if the project requirements change. Additional work will only proceed once it has been agreed by both parties.
- Changes in design may alter materials and labour requirements.
- Unexpected site conditions may require extra equipment or time.
- Additional waste removal may involve extra charges.
- Customer-approved upgrades may extend the project schedule.
3. Estimates and Pricing
Any estimate or quotation provided is based on the information available at the time it is issued. Pricing may be influenced by the size of the area, the complexity of the work, access to the site, the condition of the land, and the materials required. Although every effort is made to provide accurate and fair pricing, estimates may be updated if circumstances change or if additional information becomes available.
Quoted prices are generally valid for a limited period unless otherwise stated. After that period, pricing may be reviewed due to seasonal demand, material costs, or changes in project requirements. Customers are encouraged to confirm acceptance promptly to secure the agreed rate.
All pricing should be viewed as project-specific and may vary depending on actual site conditions.
4. Payments and Invoicing
Payment terms will be explained before work begins. Depending on the nature of the project, payment may be required in stages, upon completion, or in line with an agreed schedule. The customer agrees to pay all amounts due according to the terms set out in the estimate, invoice, or service agreement.
If payment is not received on time, Landscapers Lee may suspend work until the balance is settled. Any additional costs caused by late payment, such as rescheduling or administrative follow-up, may be charged where permitted. Customers are responsible for ensuring that payments are made in full and by the agreed deadline.
4.1 Deposits
For certain projects, a deposit may be requested before work starts. Deposits help secure materials, labour, and scheduling. Unless otherwise stated, deposits are non-refundable once materials have been ordered or work preparation has begun.
4.2 Final Payments
The final balance must be settled once the work has been completed, unless a different payment plan has been agreed in writing. Delays in final payment may affect warranty eligibility or future service availability.
5. Scheduling and Access
Project dates and times are arranged based on availability, weather conditions, and operational planning. While every effort is made to keep appointments and deadlines, landscaping work can be affected by rain, strong winds, frost, or other weather-related conditions that make safe and effective work difficult. In such cases, the schedule may need to be changed.
The customer must ensure that the site is accessible on the agreed date and that any necessary permissions, keys, codes, or access arrangements are in place. If access is restricted, the work may be delayed and additional costs may apply if the team cannot complete the job as scheduled.
Reliable access and timely communication are important for maintaining an efficient project schedule.
6. Customer Responsibilities
Customers have a role in helping projects run smoothly. Before work starts, the customer should provide accurate information about the site, including any hazards, buried services, delicate structures, drainage concerns, or protected plants. The customer should also remove personal belongings, fragile items, or anything that could obstruct safe access to the work area.
Where necessary, the customer may need to obtain permissions from landlords, neighbours, or other relevant parties. If a project requires compliance with local regulations, planning considerations, or shared property arrangements, it is the customer’s responsibility to confirm that permission has been obtained before work proceeds.
- Provide correct site information.
- Remove personal items from the work zone.
- Ensure permission for the proposed work.
- Inform the team of hidden hazards or special concerns.
7. Materials and Planting
Where a project includes the supply or installation of materials, plants, turf, gravel, stone, or decorative features, the choice of materials will normally be agreed in advance. Natural materials may vary in shade, size, texture, or appearance. These variations are normal and should not be considered defects unless they materially affect the agreed specification.
Plants, turf, and living materials are subject to seasonal conditions, soil quality, watering, sunlight, and aftercare. Because they are living products, their performance cannot be guaranteed in exactly the same way as manufactured items. Customers are encouraged to follow any aftercare instructions provided to improve establishment and long-term results.
Natural variation is a normal part of landscaping and should be expected when using organic or natural materials.
8. Waste Removal and Site Clean-Up
Many landscaping projects generate waste such as soil, branches, grass cuttings, old plants, rubble, packaging, and general debris. Unless specifically agreed otherwise, waste removal and site clean-up will be handled according to the project terms. The extent of clearing, loading, disposal, and recycling must be established in advance where possible.
If additional waste is found during the job or if the customer requests further clearance, extra charges may apply. The aim is always to leave the site in a neat and safe condition, but the final standard may depend on weather, site access, and the original scope of the work.
9. Cancellations and Rescheduling
If the customer needs to cancel or reschedule, as much notice as possible should be given. This helps avoid wasted time, reserved labour costs, and unnecessary material orders. For projects requiring deposits, cancellation terms may apply depending on the stage of the work and any expenses already incurred.
Rescheduling is often possible, but it depends on workload, weather, and availability.
If Landscapers Lee must postpone a job due to weather, supply issues, safety concerns, or other operational reasons, a new date will be arranged wherever possible. Neither party should be held responsible for delays caused by events beyond reasonable control.
10. Delays and Force Majeure
Landscaping work can be affected by circumstances outside normal control. These may include severe weather, transport disruptions, material shortages, equipment failure, illness, or other unforeseen events. If such circumstances occur, the timeline for completion may be extended without penalty.
In these situations, the business will aim to communicate changes as soon as practical and to resume work when conditions allow. The customer acknowledges that project timing may be influenced by factors that cannot always be predicted in advance.
11. Liability and Limitations
Reasonable care is taken in all work carried out, but landscaping involves outdoor conditions, uneven ground, hidden obstructions, and variable site factors. Landscapers Lee is not responsible for damage caused by pre-existing site issues, undisclosed hazards, or circumstances outside the scope of the agreed work.
The business will not be liable for indirect losses, loss of profit, or consequences arising from delays beyond its control. Liability may also be limited where the customer has not followed aftercare instructions, has altered completed work, or has failed to disclose relevant information before the project began.
Customers should always report concerns promptly so they can be reviewed and addressed appropriately.
12. Aftercare and Maintenance
Some landscaping results depend heavily on ongoing maintenance. Lawns may need watering, mowing, feeding, or protection after installation. Newly planted shrubs and flowers may require regular care to establish successfully. Hard landscaping features may also need basic upkeep to preserve appearance and function.
Where aftercare recommendations are provided, they should be followed carefully. Failure to maintain the completed work may affect appearance, survival, or long-term performance. The customer accepts responsibility for routine care once the project has been handed over, unless a separate maintenance arrangement has been agreed.
12.1 Maintenance Expectations
- Water newly planted areas as advised.
- Keep walkways and surfaces free from excess debris.
- Monitor for settlement after soil or turf installation.
- Carry out regular upkeep to preserve results.
13. Property and Hidden Conditions
Outdoor spaces may contain hidden pipes, cables, drainage systems, old foundations, buried waste, or unstable ground. Unless these are clearly visible or have been disclosed in advance, they may not be discoverable before work begins. If such conditions are encountered, the project may require modification, delay, or additional measures to continue safely.
The customer is encouraged to share any existing surveys, plans, or site information that may assist with safe working. Even with careful preparation, not all hidden conditions can be identified beforehand, and this must be accepted as part of outdoor work.
14. Ownership of Materials
Materials supplied for a project remain the property of the supplier or business until full payment has been received, where applicable. Once materials have been installed and the invoice has been settled, ownership transfers to the customer. Any reclaimed, removed, or replaced materials may be disposed of, recycled, or retained according to the agreement made for the job.
15. Disputes and Complaints
If a customer is unhappy with any part of the service, the concern should be raised as soon as possible so it can be reviewed. The business will aim to address issues fairly and professionally. Clear communication is essential, and supporting details such as photographs or descriptions of the concern may help resolve the matter more quickly.
Most issues can be handled through reasonable discussion and, where appropriate, remedial action. Customers are asked to allow a fair opportunity for the matter to be investigated before making assumptions or taking further steps.
16. Updates to Terms
Landscapers Lee may update these terms and conditions from time to time to reflect changes in services, operating practices, legal requirements, or business needs. The version applicable to a project will normally be the version in place at the time the agreement is made. Customers are encouraged to review the current terms whenever they arrange new work.
Staying informed about the latest terms helps avoid misunderstandings and supports a better service experience.
17. General Provisions
If any part of these terms is found to be invalid or unenforceable, the remaining sections will continue to apply. Failure to enforce any part of these terms at a particular time does not mean that the right to enforce it in the future has been waived. These terms are intended to operate fairly and practically in the context of landscaping services.
By proceeding with a project, the customer confirms acceptance of the current terms and conditions. This agreement helps set clear expectations for service quality, communication, payment, and project completion. It also supports a professional working relationship based on transparency, respect, and mutual understanding.
In summary, these terms and conditions exist to create clarity, reduce risk, and ensure that landscaping work is delivered in an orderly and professional manner.
